Whenever a public restroom is clearly identified as being for the use of one sex only, and is in a building or facility open to the public, it is unlawful for any person of the opposite sex who is above the age of ten years to enter or remain within such restroom.

The provisions of this article shall not apply to persons who are upon the premises of such a restroom for the purpose of

(a)      Cleaning;

(b)     Making repairs;

(c)      Any bona fide emergency involving the health or safety of an individual or the public in general.

Any person violating any section of this article shall be subject to a fine of more than $500.00.
