A CHARTER ORDINANCE EXEMPTING THE CITY OF GODDARD, KANSAS FROM CERTAIN TERMS AND PROVISIONS OF K.S.A. 14-201, AND PROVIDING SUBSTITUTE PROVISIONS RELATING TO THE ELECTION THE POSITION OF CITY TREASURER AND APPOINTMENT OF CERTAIN CITY OFFICERS.
WHEREAS, the City of Goddard, Kansas has been designated as a city of the second class effective on the 17th day of June, 2010; and
WHEREAS, the City of Goddard, Kansas deems it advisable to exempt itself from the provisions of K.S.A. 14-201 requiring the position of city treasurer be elected in certain cities of the second class; and
WHEREAS, the City of Goddard, Kansas deems it advisable to exempt itself from the provisions of K.S.A. 14-201 requiring the positions of judge of the municipal court, city marshal-chief of police, city clerk, city attorney, and police officers to be appointed annually;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GODDARD, KANSAS:
The City of Goddard, Kansas, by virtue of the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to make inapplicable to it and exempts itself from the provision of K.S.A. 14-201 requiring the position of city treasurer be elected and requiring annual appointment of certain city officers.
In exempting itself, the City of Goddard, Kansas finds that such provision is applicable to cities of the second class, but not uniformly applicable to all cities. Therefore, the City of Goddard, Kansas hereby adopts substitute and additional provisions on the same subject as hereinafter provided.
The Mayor, by and with the consent of the council, shall appoint a City Treasurer, who shall hold office until his or her successor has been appointed and qualified, or until he or she is removed by majority vote of the entire city council.
The existing City Treasurer of the City of Goddard, Kansas shall hold office until his successor has been appointed and qualified, or until removed, as provided for above.
The Mayor, by and with the consent of the council, may appoint a city attorney, municipal judge, Chief of Police, city clerk, city administrator and such other officers as may be deemed necessary for the best interest of the city. Such officers shall hold their respective offices until their successors have been appointed and qualified, or until they are removed by a majority vote of the entire city council.
The persons currently serving in the positions of municipal judge ,Chief of Police, city clerk, and city attorney, shall hold office until his/her successor has been appointed and qualified, or until removed, as provided for above.
