A CHARTER ORDINANCE EXEMPTING THE CITY OF GODDARD, KANSAS, FROM THE PROVISIONS OF K.S.A 12-1697(a), PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS RELATING TO THE LEVY OF A TRANSIENT GUEST TAX, AND REPEALING CHARTER ORDINANCE NO. 20 IN ITS ENTIRETY.

WHEREAS, K.S.A. 12-1692 to 12-1699 authorizes a levy by cities of a transient guest tax, which provisions are not uniformly applicable to all cities; and

WHEREAS, pursuant to Article 12, Section 5 of the Constitution of the State of Kansas, cities may exempt themselves from such provisions and provide substitute and additional provisions therefore; and

WHEREAS, the City of Goddard, Kansas previously adopted Charter Ordinance No. 20 dealing with said subject.

NOW THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GODDARD, KANSAS:

SECTION 1. Authority.

The City of Goddard, Kansas, a city of the second class, by virtue of the authority granted in Article 12, Section 5 of the Constitution of the State of Kansas, hereby exempts itself from and makes inapplicable the provisions of K.S.A. 12-1697(a), and provides the following substitute and additional provisions on the same subject. All other provisions of K.S.A. 12-1692 through 12-1699, including those related to definitions, administration, enforcement, and collection, shall remain applicable and are hereby adopted.

SECTION 2. Transient guest tax.

Pursuant to its Home Rule authority, the City of Goddard hereby levies a transient guest tax at the rate of nine percent (9%) upon the gross receipts derived from or paid directly or through an accommodations broker by transient guests for sleeping accommodations, exclusive of charges for incidental services or facilities, in any hotel, motel, or tourist court located within the City.

SECTION 3. Use of Revenue.

Revenues received from the transient guest tax shall be credited to the Tourism and Convention Promotion Fund and may be used for the following purposes:

1.           To pay any obligations (including bonds, leases, or contracts) resulting from or directly attributable to a STAR bond project area established by ordinance of the City;

2.           To fund marketing efforts to attract conventions and visitors to the City of Goddard; or

3.           To fund attractions or facilities deemed to have an advantage or interest to the City of Goddard.

SECTION 4. Repeal of Charter Ordinances No. 20.

Charter Ordinance No. 20 is hereby repealed, and replaced with this Charter Ordinance.
